By placing using our Products and Services, you are agree to the below Terms & Conditions.

1. Bookings
1.1 All bookings will be regarded as provisional until a non-refundable deposit for the required services (as set out in Clause 2.4 below) has been received
1.2 All Event Bookings will be confirmed in a written contract as discussed with yourself, this may be in the form of a quotation via Square. THE THREE CHEERS will send this to you with a copy of T&C Via email when deposit is due.
1.3 THE THREE CHEERS recommend that bookings are made at minimum 30 days in advance. THE THREE CHEERS may be able to accept bookings up to 24 hours prior, providing they are available and able to fulfil this request
1.4 Upon Booking THE THREE CHEERS will discuss with you set up times & requirements, they will require a period of time prior to the event to fulfil any set up requirements.
1.5 It is the Client’s sole responsibility to confirm if the venue allows; helium tanks, helium balloons, tall structures, wall hangings, tall ladders, etc. prior to any payment made to THE THREE CHEERS. If the Client fails to confirm the venue’s rules for balloons, helium tanks/balloons, wall hangings, tall ladders, etc. prior to making any payment(s), said payment(s) will be forfeited and considered non-refundable.

2. Pricing & Payment
2.1 All prices quoted by THE THREE CHEERS may be amended when agreed with the Client and the Client will reasonably consider any errors or omissions or where an increase is caused by a change in the circumstances beyond the reasonable control of THE THREE CHEERS
2.2 Any query arising from an invoice must be notified to THE THREE CHEERS in writing by the Client within 10 working days of the date of the invoice receipt. Failure to comply will render the full invoice payable on the due date.
2.3 It is strictly the responsibility of the representative of the Client confirming the booking to inform all relevant parties of the payment terms, as set out by THE THREE CHEERS
2.4 Deposit – A deposit of 50% of the total fee payable (including VAT), as quoted and agreed in the written proposal (attached), of any event or programme shall be payable on confirmation of the order. The remaining 50% shall be known as the “balance”.
2.5 Balance Due – the balance of the total fee shall be payable 30 days prior to the event date unless otherwise agreed. If payment is not received 30 days prior, we allow a 7 day grace period at our own discretion. If we receive payment, we will make our best attempt to fulfil your order, however if we are unable to deliver this we reserve the right to retain your deposit to cover the loss of profit, preparation or materials.
2.6 Additional Expenses – any additional expenses or fees resulting from any changes made by the Client, that have not been quoted in the agreed proposal but subsequently incurred by THE THREE CHEERS, will be invoiced separately after the event. Payment will be due within 5 working days of presentation, any queries thereon raised within 3 working days of presentation and payment shall be made in accordance with Clause 2.9. THE THREE CHEERS will agree any additional expenses or fees with the client prior to these being incurred.
2.8 Late Bookings – Should a booking/order be made within 30 days of the event date, payment in full will be required to secure the event.
2.9 For some hire products, THE THREE CHEERS may require a refundable Deposit, this will be refunded to the client within 7 working days of return. If THE THREE CHEERS finds any irreversible damage to their items, these will be charged at full and deposit will not be returned.
2.10 It is the clients responsibility to ensure that Hire items are returned to THE THREE CHEERS in a timely fashion. All items must be checked for shortages upon delivery and notified to us the same day, any items notified as missing after the day of delivery will be classed as lost by customer and charged as per replacement, it is the responsibility of the customer to notify THE THREE CHEERS. Upon collection/receipt of goods after hire, if any hired items are missing then THE THREE CHEERS will inform you within 7 days. If the missing items are returned within 14 days after the event no charges will be applied. Failure to return the missing items will result in the full replacement fees being charged as per the Replacement Price directly to your card. If payment has been made by another method then you will be sent an invoice to make payment within 7 days.
2.9 Methods of Payment:
We accept card payments via our third party payment provider Square or via our website www.thethreecheers.com. We also accept Bank Transfer to the following account:

The Client must inform THE THREE CHEERS in writing (preferably by email) of any bank transfers

3. Cancellation
3.1 This clause applies to the following: where the client (a) cancels the entire event, (b) cancels partial use of the facilities for the event or (c) reduces the duration of the event as a result of which the contracted value is reduced.
3.2 Should an event be cancelled, the following cancellation charges will apply and extend to the total charge which includes: any required accommodation, function room hire, equipment, pre-booked food and beverage charges. In addition, the client will settle any third-party charges incurred by THE THREE CHEERS on behalf of the client.

3.3 All cancellations must be received in writing from the client and will be deemed to take effect from the date of receipt.
3.4 THE THREE CHEERS reserves the right to cancel the client’s booking if there has been a change of more than 40% of the client’s original contract or if the Customer Fails Clause 2.5. Written notification will be sent to the client.
3.5 Any postponements of confirmed and contracted business or any Public Health Emergency declared by Public Health England, the Chief Medical Officer for England or any law or any action taken by the UK government or UK public authority that directly affects the operation of the event will not be considered as a cancellation in accordance with the above cancellation clauses. This will be treated separately and we will move your event free of charge or offer a 100% refund.

4. Liability
On some events, the activities that the Clients will undertake may be inherently dangerous although all guests are fully supervised throughout. As such neither THE THREE CHEERS or its employees or agents shall be liable for any damage, loss, delay or expenses caused to the client, its employees, agents, licensees or invitees or any other persons attending the event except insofar as it results from the negligence of THE THREE CHEERS or breach of contract. Please note that during particular events and on certain activities it may be necessary to request individuals to sign a liability waiver on the day of the event (although the same does not purport to exclude liability for damage to personal property of the Clients employees or staff or property damage caused to the Clients property or personal injury arising as a result of the negligence of THE THREE CHEERS), in which instances THE THREE CHEERS agrees to indemnify and hold the Client harmless against all such claims. THE THREE CHEERS shall provide Public Liability insurance cover for each and every claim.
5. Force Majeure
THE THREE CHEERS shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God (other than one arising from or related to directly or indirectly from volcanic ash), strikes, lockouts, accidents, war, fire, breakdown of plant or machinery, and THE THREE CHEERS shall be entitled to a reasonable extension of its obligations.
6. Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

8. Health and Safety
8.1 At no time should helium be inhaled it is an asphyxiant. THE THREE CHEERS accepts no responsibility for any guests, party members, the customer, hotel or venue staff who may inhale helium and who may experience breathing difficulties through the inhalation of helium or any other effects.
8.2 The balloon décor will be positioned in such a manner as to cause the least amount of disruption and in the best possible area for health and safety reasons. THE THREE CHEERS accepts no responsibility for any accidents caused by the customer, guests, party members, hotel or venue staff or members of the public at your function moving, hitting or interfering with the balloon décor.
8.3 THE THREE CHEERS sometimes use water weights to weigh down their balloon arrangements. The weights are secure and will only burst if the decor is moved, hit or interfered with. Please ensure that if ordering this type of decor that no-one tamper, hit or interfere with these balloons and, under no circumstances should columns be moved.
8.4 Please ensure all guests and your venue are aware that the function area should be left clear whilst we set up our balloon decoration to ensure we have a clear working area. At no time should any guests, party members, hotel or venue staff interfere or touch any of our equipment or helium canisters. Keeping our working area clear helps avoid any accidents when dealing with heavy helium canisters or, working with invisible thread and we accept no responsibility for any accidents caused by the customer, guests, party members, hotel or venue staff. The whole function room should be kept closed to guests and party members in particular whilst we work. Whilst we appreciate hotel or venue staff will require access to re-stock bars etc. we do ask that they do not interfere where possible with our working area and stay clear of this area.
8.5 Please help protect the environment. After your event has finished please ensure that you, the customer, guests, party members, hotel or venue staff do not release any balloons outside and dispose of these in an appropriate manner. Balloons from balloon decorations and displays are not suitable for outdoor release. They may have ribbon or other decoration supplies attached to them. Foil balloons in particular can cause damage to electricity lines if they come into contact with these.
